Any online estimate, preliminary project range, verbal estimate, or estimate provided by email is a good-faith approximation based on the information available at the time.
Actual project costs may vary depending on site conditions, measurements, project access, materials, labor requirements, permits, engineering requirements, changes in scope, customer selections, unforeseen site conditions, and other project-specific factors.
Final project pricing and scope will be established in a written proposal, contract, or service agreement.
Service Agreements
Landscaping, landscape construction, hardscaping, artificial turf installation, irrigation work, outdoor improvements, and other services performed by OE Landscape may be governed by a separate written proposal, contract, or service agreement.
Depending on the project, the written agreement may include:
- ✓ Scope of work, materials, and specifications.
- ✓ Project pricing and payment schedule.
- ✓ Deposit and progress-payment requirements.
- ✓ Estimated project schedule and timeline.
- ✓ Warranty terms, when applicable.
- ✓ Change-order procedures.
- ✓ Property-owner responsibilities, site access, and project requirements.
If any provision of these website Terms and Conditions conflicts with a signed written service agreement, the signed service agreement will control with respect to that particular project.
Payments
Payment requirements are detailed in the applicable written proposal or service agreement.
Unless otherwise specified in writing:
- ✓ A deposit may be required before work begins, subject to applicable California law.
- ✓ Progress payments may be required as specified in the signed agreement.
- ✓ Final payment will be due according to the payment schedule contained in the applicable agreement.
Accepted Payment Methods
OE Landscape may accept Venmo, major credit cards, check, cash, and other approved payment methods.
Past-due balances may be subject to interest, collection charges, or other remedies to the extent permitted by applicable law and the applicable written agreement.
Where permitted by law and provided for in the applicable agreement, the customer may also be responsible for reasonable costs associated with collecting unpaid balances.
Limitation of Liability
To the fullest extent permitted by applicable law, OE Landscape will not be liable for indirect, incidental, special, consequential, exemplary, or punitive damages arising from the use of this website or from services provided by OE Landscape.
Such damages may include, without limitation, loss of use, lost profits, business interruption, or other consequential losses.
To the fullest extent permitted by applicable law, OE Landscape's aggregate liability for a claim arising from a specific project will not exceed the amount paid to OE Landscape for the specific work giving rise to that claim.
Nothing in these Terms is intended to exclude, restrict, or limit liability where such exclusion or limitation is prohibited by applicable law.
Certain projects or property conditions may require the property owner or other responsible party to review and acknowledge project-specific risks, disclosures, or other documents before work begins.
